Legislators pass new law that 'levels the playing field' for charter schools

* HB 113 extends contract violation consequences to charter school teachers *

May 25, 2015: The Ohio General Assembly just passed House Bill 113 containing a provision addressing charter school teachers who violate their employment agreement.

Under current law, a traditional school teacher who signs, but later breaks their employment contract, could face the suspension of their teaching license. However, those professional sanctions have never applied to charter school teachers.

This disparity created significant hardships for charter schools, and their students, when teachers leave in the middle of the school year.

House Bill 113 corrects this irregularity by creating a new statute, ORC 3314.103, mirroring the teacher contract law already available for traditional district schools.

No community school teacher shall terminate the teacher's contract after the tenth day of July of any school year or during the school year, prior to the termination of the annual session, without the consent of the community school's governing authority or operator, and such teacher may terminate the teacher's contract at any other time by giving five days written notice to the employing governing authority or operator.

Upon complaint by the employing governing authority or operator to the state board of education and after investigation by it, the license of a teacher terminating the teacher's contract in any other manner than provided in this section may be suspended for not more than one year.

Ron Adler, OCQE President said, "we were made aware of the inconsistency in the law two years ago. Our Director of Legislative Services has worked diligently with members of the General Assembly to achieve this legislative accomplishment for all Ohio charter schools."

House Bill 113 now moves on to Governor John Kasich for his review and signature.

Paolo DeMaria Named State Superintendent Of Public Instruction


The State Board of Education voted Wednesday to hire longtime Ohio education policy expert Paolo DeMaria as the state's incoming superintendent of public instruction.


He was among 17 candidates that applied for the chance to succeed former Superintendent Dick Ross, who retired last year. (See Gongwer Ohio Report, April 14, 2016)


Mr. DeMaria, well known in education policy circles and at the Statehouse, currently works as a consultant for Education First Consulting where he was a founding partner.


He served as executive vice chancellor for the Ohio Department of Higher Education from 2008-2010 and as association superintendent for school options and finance for ODE from 2004-2008.


Other career highlights include stints as chief policy advisor to former governors George Voinovich and Bob Taft between 2000-2004, director of the Office of Budget and Management from 1998-1999, and senior fiscal analyst to the Ohio Senate from 1988-1991

.
Mr. DeMaria has a master's from Ohio State University and a bachelor of arts from Furman University.
